This microsite (the “Site”) invites you to put any questions you may have concerning the scaling up of your business to Scale Ups and Down Podcast (the “Panel”) by way of an online form (a “Submission”). Although we can’t promise that each and every question submitted to the Panel will be answered, we will endeavour to read all of them and ensure that each question is given proper consideration.

In order to manage everyone’s time and ensure that the Site fulfils its purpose, we have prepared a simple set of terms and conditions which will apply to the content of any Submission you choose to send to us via the Site:

  • The Site and the Panel is managed by Mags Creative. 
  • These terms and conditions (“Terms”) will become binding on you from the moment when your Submission is posted via the Site. If you do not agree with these Terms, please do not use the Site.
  • We reserve the right to amend these Terms at any time without prior notice. Any such changes will be published on the Site.
  • Information (including personal information) submitted in a Submission will, subject to any contrary provisions in these Terms, be processed in accordance with our Privacy Policy here. You specifically authorise and grant your consent to the processing of any personal data contained in a Submission by our authorised sub-processors in accordance with our Privacy Policy. In the event of any inconsistency between our Privacy Policy and these Terms, the latter will take precedence.
  • By posting a Submission, you grant to us and our assignees, including without limitation Mags Creative, an unrestricted, unlimited and irrevocable right (but not the obligation) to host, use, reproduce, publish, broadcast, display, store, cache, publicly perform, translate, edit, adapt, redact, excerpt and distribute your Submission in any and all media formats and channels (including for promotional purposes), subject to your Submission being selected for publication on the Site and/or further consideration by the Panel. Submissions not selected for publication or further consideraiton will be subject to our deletion policy below.
  • Submissions may be read aloud and/or quoted on the Site and will also be listened to by our staff and other third parties involved with the Panel and/or the Site. As such, any Submission uploaded to the Site should be considered non-confidential and, by posting a Submission, you agree that we may make use of your Submission in any manner as we see fit, provided that such use is in accordance with these Terms.
  • We require each Submission to include your name and a functioning email address as we will follow up with founders whose Submissions are to be considered by the Panel. Accordingly we reserve the right to publish your name in each Submission, details of your business and, if provided, the city or regional location of the individual(s) concerned. By providing such information you also consent to us disclosing your personal information to Google. Mags Creative will only use this information to communicate with you in relation to the Panel’s consideration of your Submission and for no other purpose, save as agreed with you.
  • You should not include any proprietary, sensitive or confidential information (other than your name and email address) concerning your business with your Submission as we do not undertake that any such information will be kept confidential. Any such material sent to us via the Site will not be considered for publication and will be irretrievably deleted within a reasonable time thereafter.
  • Submissions should not include information capable of identifying third parties (other than the person or persons making the Submission) in any circumstances. This is to avoid the Panel, Mags Creative or others involved in the Site being exposed to claims involving defamation or infringement of an individual’s privacy or data protection rights. We reserve the right to edit or delete any User Contribution where this rule is not adhered to.
  • Any public advice given by the Panel in relation to your Submission (either on the Site or otherwise) is given entirely without any express or implied warranty of any kind. You must assume all risk in connection with any actions you take in relation to the responses given by the Panel in relation to your Submission, as such advice given will only be in response to the content of the Submission and without full knowledge of the legal parameters, finances and operation of your business. 
  • Users under 18 years of age are strictly prohibited from posting Submissions.
  • We undertake to delete all Submissions which are not published on the Site or considered by the Panel within sixty (60) days following the date the decision is made not to use them.
  • By posting a Submission you warrant the following:
    • Your Submission does not violate the rights of any other person (including without limitation copyright or moral rights, or where the Submission amounts to a breach of another person’s confidence or privacy);
    • Any other person identified by name in your Submission in relation to your business has consented to being so identified;
    • Your Submission is not false, inaccurate or misleading;
    • Your Submission is not obscene, lewd, lascivious, violent, harassing, libellous, slanderous, or otherwise objectionable (as determined by us);
    • Your Submission is not designed to ridicule, disparage, intimidate, harass, threaten, abuse or discriminate against anyone;
    • Your Submission is not designed to promote any product or service other than the products and services of your own business;
    • Your Submission does not violate any applicable law, regulation, or rule, or amount to a contempt of court.
  • You agree to hold the individual members of the Panel, Google and us free and harmless from any liability that arises in relation to your breach of any of the warranties above or your breach of these Terms.
  • You are not entitled to payment or any other form of compensation for your Submission.
  • If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms, which shall remain in full force and effect.
  • These Terms and any non-contractual obligations connected to them will be governed by, and construed in accordance with, the laws of England and Wales and the English courts shall have exclusive jurisdiction to settle any dispute which may arise under or in connection with them.
